Man Charged In Border Patrol Agent Brian Terry's Murder Gets Plea Deal
TUCSON, Ariz. - Federal prosecutors in Tucson entered a plea deal on Monday with one of the men charged in the 2010 murder of U.S. Border Patrol Agent Brian Terry. Terry was part of an elite task force when he was killed north of Nogales, Arizona.
Rosario Rafael Burboa-Alvarez has pleaded guilty to first-degree murder. Burboa had been accused of assembling a group of men sent to rob Mexican cartel drug smugglers.
Terry was shot and killed during a gunfight with this so-called "rip crew."
As part of the plea deal, prosecutors will ask for a sentence of 360 months in prison for Burboa, with credit for time served since his arrest in October 2012.
The U.S. has also agreed not to execute Burboa and to dismiss the remaining charges against him.
Some of the weapons used to shoot Terry have been linked to the botched "Fast and Furious” federal operation to trace gun smuggling.
Another man was sentenced to 30 years in prison for Terry’s murder last year.
The remaining defendants will face trial in Tucson in September.
