The Maricopa County Attorney’s Office will no longer be working on the case of a fatal crash involving a self-driving Uber car in Tempe. The Yavapai County Attorney’s Office was asked to take it over.

Last week, the Tempe Police Department completed its investigation into the crash that killed 49-year-old Elaine Herzberg on Mill Avenue in March. The Maricopa County Attorney’s Office has asked that the case be reassigned, citing a potential conflict of interest.

Amanda Jacinto with the county attorney’s office said the case will be handed over because the office worked with Uber on a public safety campaign in the past.

"In 2016, MCAO teamed up with Uber during the ‘Save Lives Don’t DUI’ campaign, encouraging the public to contact Uber and use the service to avoid the risks associated with drinking and driving,” Jacinto said. 

Jacinto said Yavapai County has reviewed high profile cases for them in the past so their office was asked first.
