Phoenix Attorney Says Mask Mandate Should Withstand Legal Challenges

Many Arizona communities now require that people wear masks to slow the spread of coronavirus. 

Phoenix attorney Joshua Black says it’s not clear how local governments will enforce the guidelines, but they should be on solid legal footing. 

Private businesses and cities do have the right to mandate mask wearing, he said, and although some may claim the mandate is against the Constitution, that view is not likely to hold up in court. 

“I don’t see any real winning argument there," Black said. "I haven’t heard anything that I see as sound that says that there’s a Constitutional argument that we should not be wearing masks or that we’re not required to wear a mask.”

Black says that he expects to see cases involving wearing masks for long periods of time in the workplace.
