Maricopa County Judge To Hear New Arguments From Gym Owners

A Maricopa County Superior Court judge has agreed to hear new arguments by gym owners who say Gov. Doug Ducey keeps moving the goalposts for their businesses to safely reopen.

Three weeks ago, Judge Timothy Thomason ruled in favor of Ducey’s initial order to close gyms and fitness centers.

Now, Judge Thomason acknowledges that that ruling was made on the basis that there was to be a process, with guidelines and forms for these businesses to follow, that could lead to their reopening. 

However, that process was never created, and while the Arizona Department of Health Services issued the form of protocols last week, it is now being called a draft document. And Ducey has extended the closure another two weeks.

The gym owners are arguing that they are prepared to follow any protocols and that their businesses are being treated with a double standard since the state is working towards having schools reopen.

The judge will hear more arguments on Monday.
