Prescott Joins Tucson In Legal Battle Over Even-Year Election Law

In a new court filing, Prescott has joined the legal fight against the Republican-controlled state Legislature and Arizona attorney general.

The Arizona Supreme Court is considering a case that could force Tucson, Prescott and other charter cities like them to conform to even-year elections.

While charter cities have the right to decide when their local elections are held, a 2018 law says if voter turnout falls below a certain threshold compared to the most recent statewide vote, they must hold even-year elections. 

Prescott argues the law will not increase voter turnout, will cause confusion and make local elections more partisan. The city says it would have to either add or take away a year, to terms of already elected officials.

This is the second attempt to make cities conform. Similar legislation was thrown out in court in 2014.
