Title 42 allows border agents to turn away migrants, on the grounds of COVID-19, before they can seek asylum. When President Joe Biden tried to dismantle it, a group of 19 Republican state attorneys general sued.

In a win for that group, the U.S. Supreme Court will allow the policy to stay in place, for now.

Arizona Attorney General Mark Brnovich, who was a part of that challenge, says Title 42 is not meant to be permanent, but he doesn’t think any other policy is doing as much to help mitigate illegal immigration.

"It is one of the few tools we have left in our toolbox that is stopping even more people from illegally entering our country," Brnovich said.

The Biden administration says Title 42 was just a health policy that should now be terminated; and that Congress needs to pass immigration reform measures.

The U.S. Supreme Court will hear arguments next year.
