Mayes joins 11 other states to sue FDA over abortion drug restriction

Attorney General Kris Mayes is joining 11 other states — Washington, Oregon, Nevada, Delaware, Illinois, Connecticut, Colorado, Vermont, New Mexico, Michigan and Rhode Island — in suing the FDA over its restrictions of the drug mifepristone, which is used in an abortion regimen.

The lawsuit claims those restrictions are burdensome, and risks the privacy of patients and providers.

According to the Attorney General’s Office, both parties must sign an agreement certifying a patient has decided to end a pregnancy, regardless of whether it was an abortion or miscarriage.

Mifepristone falls under the FDA’s Risk Evaluation and Mitigation Strategies restrictions.

Those often apply to dangerous drugs such as opioids and high dose sedatives.

The FDA faces a different lawsuit from the Attorneys for the Alliance Defending Freedom, attempting to block access of the drug. They claim the agency ignored evidence before approval.
