Shady Park and Mirabella retirement community come to agreement over noise dispute
After a lengthy legal battle over concert noise, a downtown Tempe venue and a senior-living facility on the ASU campus have reached a resolution.
Shady Park, a club near downtown Tempe’s Mill Avenue, had been hosting music acts for several years when the Mirabella at ASU facility — a residential high-rise for older adults — opened in 2020. The club was temporarily shut down because of the pandemic, but resumed concerts after reopening, leading to a lawsuit from Mirabella.
As part of the new agreement, Shady Park will implement sound mitigation measures to allow the venue to hold concerts while reducing the noise level for the outside community. Both parties have agreed to dismiss the lawsuit.
The city of Tempe will work with Shady Park to obtain the permits needed to set up additional noise mitigation measures.
