Lawsuit Questions Constitutionality Of Tucson Election System

The city of Tucson has a unique system of electing local officials. And a group — primarily Republicans — think that uniqueness also makes it unfair.

That led to a lawsuit —  with the 9th U.S. Circuit Court of Appeals determining its constitutionality. A three-judge panel decided the system violates the 14th Amendment and the Equal Protection Clause. But an appeal to a larger 9th Circuit panel will hear the case.

Jim Nintzel, political writer for the Tucson Weekly, explained the issue.
