A week ago, Sheriff Penzone said the County Attorney advised him to immediately halt the detention of individuals flagged for immigration violations by Immigration and Customs Enforcement.

Penzone said inmates would be released upon an order from a judge and the jail would no longer hold immigrants for up to 48 hours for ICE to detain them. After the change, the Sheriff’s Office said more than 50 immigrants with ICE detainers were released.

Penzone said his department has now met with ICE to work out a system to transfer custody. In a statement released Friday night, Penzone said the County Attorney believes it is legal to transfer custody of detainees to ICE within the county jails.

The Sheriff said immigration violators will then be held in an ICE detention center.
