Legal Same-Sex Marriages Now Recognized Under Tax Code

August 29, 2013

Legal same-sex marriages are now recognized under the federal tax code. The U.S. Department of the Treasury and Internal Revenue Service announced Thursday that tax returns for same-sex marriages will be classified as married.

Arizona law does not recognize same-sex marriages, but the federal ruling still applies for same-sex married couples living in Arizona.

Arizona Department of Revenue spokesperson Sean Laux said these couples will still have to file separate tax returns at the state level.

"Each individual within the relationship [has] to file a single return, single Arizona return. They would not be allowed to file a joint return in Arizona," Laux said.

Laux said the revenue office will have tax filing instructions for same-sex marriages by the end of the year.
