Lawsuits By Yarnell Homeowners Against State Dismissed

A judge has dismissed two lawsuits filed against the state by homeowners whose properties were destroyed in the Yarnell Hill Fire.

The lawsuits say Arizona and its Forestry Division failed to use ground and air resources to suppress the fire, which broke out June 2013.

But a Maricopa County Superior Court judge agreed Wednesday with the state's argument that it didn't have a duty to protect the properties.

The homeowners said they're disappointed with the ruling and plan to appeal.

The blaze destroyed 127 homes in Yarnell and neighboring communities, about 80 miles from Phoenix. The Yavapai County Assessor's Office estimates property damage at $17 million. 

Nineteen members of the Granite Mountain Hotshots were killed fighting the wildfire, making it the deadliest in Arizona history.
