A lawsuit filed Wednesday in federal court claims Theranos negligently maintained labs and misled consumers.

The suit posted on the website of Hagens Berman, the California law firm that filed it, details the plaintiff’s visit to a Phoenix Walgreens last fall.

It says his experience differed greatly from what Theranos promoted. The company touted proprietary technology that could perform hundreds of blood tests from a tiny sample. But, the lawsuit alleges Theranos failed to meet federal guidelines, didn’t use its own blood testing device and earlier this month voided two years of test results.

Theranos spokeswoman Brooke Buchanan told KJZZ the lawsuit is without merit and "the company will vigorously defense itself against these claims."

According to the company’s website, it operates 44 wellness centers in Arizona, including 40 in Walgreens stores.

For the suit to move forward, a judge must certify there are a number of people in the same situation as the plaintiff.
