Attorneys for those in the Deferred Action Program are back in court, in an effort to force Arizona to grant their clients driver's licenses. The licenses have been denied by Governor Brewer under a state law that says people have to prove they're authorized to be in the country to get a license. The governor maintains the Deferred Action program is not authorized, but simply an administrative decision by the Obama administration not to pursue those in the program. But, Karen Tumlin of the National Immigration Law Center wants the 9th United States Circuit Court of Appeals to issue an injunction against the state's position.

“Of course the plaintiff and other Dreamers in the state are being harmed,” Tumlin said. “They are being harmed by a policy that discriminates against them. They are being harmed by a policy that singles them out and treats them differently then everybody else who has temporary status to be in the country.”

Tumlin says the state already issues licenses to those in other Deferred Action programs, and she says that entitles the dreamers to licenses too.
