Attorney files to exempt 2 groups from having to disclose donors under Prop. 211

Two groups that tried to block a voter approved initiative aimed at revealing dark money sources are now working to at least get themselves exempt.

Attorney Scott Freeman has argued that Proposition 211’s requirements to disclose the true source of campaign donations violates state constitutional protections for speech and privacy.

Those claims were rejected last month by a Maricopa County judge. That judge is now letting Freeman argue that the provisions cannot be applied to the Free Enterprise Club and the Center for Arizona Policy. 

But Judge Scott McCoy said the groups will have to show that they have a reasonable probability that the disclosure of donors will subject them to threats. 

Proposition 211 was passed by a nearly 3-1 margin.
