The Arizona Legislature and the governor have agreed to bar the state from restricting the use — or sale — of a vehicle “based on its energy source.” This includes requiring vehicles to be zero-emission.

Local governments will also be blocked from creating restrictions.

Sierra Club lobbyist Sandy Bahr sees this provision as a sell-out by Democrats. The Legislature was negotiating the Prop. 400 transportation deal.

“It is insane. It's wrong. And I don't know why in the world the governor's office or proponents relative to action on climate would agree to that kind of thing.”

House Minority Leader Lupe Contreras said Democratic members had little choice but to agree to the provision because there were higher-priority issues.
